Terms of Service

These Terms of Service (“Terms”) govern services provided by MainStreet Web Co. (“MSW Co.,” “we,” “us,” or “our”) to you (“Client,” “you,” or “your”). By submitting payment or completing a project intake, you agree to the terms below.

1. Scope of Services

MSW Co. provides productized website builds, hosting, maintenance, and optional enhancements as described on our website and selected during checkout.

Only services explicitly included in the selected package are covered under these Terms. Any additional work may require separate scoping and pricing.

2. Project Intake & Communication

  • To keep pricing fair and delivery efficient, MSW Co. operates through a structured, guided setup rather than traditional sales calls.
  • Clients provide project details through an intake form.
  • AI-assisted tools may be used internally to draft content or workflows.
  • All work is reviewed and approved by a human before delivery.
  • The service model is currently in alpha testing and may evolve over time.
  • Clients are responsible for providing accurate and complete information. Delays caused by missing or incorrect information may affect timelines.

3. Timelines & Delivery

All delivery timelines are estimates, not guarantees, and begin after intake is completed and required details are confirmed.

Timelines may be affected by:

  • Incomplete or delayed information
  • Scope changes
  • External platform dependencies

4. Payment Terms

Deposit

  • A refundable deposit is required to begin work.
  • The deposit applies toward the total project cost.
  • The deposit is refundable until the website is delivered for review.

Remaining Balance

  • The remaining balance is due after final approval and before website launch.
  • Once approval is given, a final payment link will be sent.
  • The website will not be launched until payment is received.

5. Refund Policy

Website build fees are refundable if the Client is not satisfied with the delivered website.

Refunds do not apply to:

  • Third-party costs (domains, subscriptions, external tools)
  • Hosting or maintenance fees already incurred
  • Optional enhancements once implementation has begun

Our goal is to deliver quality work, not to retain payment from a poor fit.

6. Revisions & Scope Changes

Each website build includes reasonable minor revisions based on the original intake.

Requests that exceed the original scope may be classified as Major Content Updates and priced separately.

7. Hosting, Maintenance & Domains

Hosting and maintenance services are offered on a subscription basis.

These services include:

  • Hosting and uptime monitoring
  • Security and backups
  • Minor content updates
  • Ongoing behind-the-scenes optimization

Domains

  • Domains are only purchased or managed by MSW Co. for clients on an active hosting and maintenance plan.
  • Domain costs are billed separately or bundled as disclosed at purchase.
  • Clients without hosting and maintenance are responsible for domain ownership and management.
  • Sites without an active hosting and maintenance plan are delivered as-is after launch.

8. Optional Enhancements & Automation

  • Optional enhancements, including automation and AI-assisted features, may involve setup fees and ongoing monthly costs.
  • Setup fees are non-refundable once implementation begins.
  • Monthly services may be canceled going forward.
  • Performance of third-party platforms cannot be guaranteed.

9. SEO & Optimization Disclaimer

Search engine optimization, AI optimization, and related services are provided on a best-effort basis.

MSW Co. does not guarantee:

  • Search rankings
  • Traffic levels
  • Lead volume
  • Business performance outcomes

10. Client Responsibilities

The Client agrees to:

  • Provide accurate information
  • Use the website in compliance with applicable laws
  • Ensure content claims are truthful and lawful

MSW Co. is not responsible for the legal compliance of Client-provided content.

11. Intellectual Property & Attribution

Upon full payment:

  • The Client owns the final website content and design.
  • MSW Co. retains ownership of internal systems, frameworks, and non-client-specific code.
  • MSW Co. may display completed websites for portfolio and promotional purposes.
  • A small “Built by MainStreet Web Co.” attribution may appear in the website footer.
  • Removal of attribution may be available for an additional fee.

12. Limitation of Liability

To the fullest extent permitted by law, MSW Co.’s liability is limited to the amount paid by the Client. MSW Co. is not liable for indirect or consequential damages.

13. Termination

Either party may terminate services at any time by written notice. Refunds will be handled according to these Terms.

14. Modifications

These Terms may be updated periodically. The version in effect at the time of purchase governs that engagement.

15. Acceptance

By submitting payment or completing intake, you acknowledge that you have read, understood, and agreed to these Terms of Service.
